Assessing Child-Related Risk for Your Website

Here are some of the questions to ask yourself and your online business partners in order to calculate your site’s exposure and plan its response to the risks associated with underage users:

Is your site primarily or partially aimed at users under 18? What about those under 12 years of age?

Even if you don’t intend to get that audience, is your site likely (by its content) to attract such users? Does your site collect any personally identifiable information somewhere within its pages? (Remember that even an e-mail address for questions may constitute collection of information.)

Do you ask your users for their ages? If so, is your site programmed to track or respond differently to users who claim to be under 18?

Is your company or your Web site likely to be subject to age- related regulation?

Does your industry have its own self-regulatory privacy or commerce standards for child-focused Web sites?

Do you have a reliable means of verifying users‘ claimed ages? Is it convenient for your site’s visitors to use?

Do you have any public posting or real-time discussions on your site? If so, have you designated an employee or contractor to act as a moderator to ensure that inappropriate or harmful material is removed?

If you are required by law or regulation to obtain parental consent, have you created the site and business mechanisms to do this?

Are you prepared, if a parent requests it, to cancel a purchase made by a child on the site?
